TRANSPORT MANAGEMENT SOFTWARE

The “HAULIER” software application is a computer program and is the property of CUSTOM BUSINESS SOLUTIONS LTD. The program is protected under copyright law and is licensed strictly in accordance with the conditions specified in this software license. Sale, lease, hire rental or re-assignment to, or by, a third party without the prior and written permission of Custom Business Solutions Ltd is expressly prohibited.

2. License

The demonstration license grants the customer a temporary right for 3 months from installation to use a single copy of the program for demonstrative purposes only. All terms and conditions stated below still apply.

The customer license grants the customer the right to use copies of the program only as agreed in a contract between parties. It is effective until terminated in writing by CBS.

A license granted under this agreement authorises the user to use the licensed program in any machine readable form on one computer system (herinafter referred to as the “System”). The licensed programs may be removed from one system and transfered to another system provided always that the licensed programs are only used on one system at a time unless a separate license fee has been paid for each additional system.

This agreement and any of the licenses, programs or materials to which it applies may not be assigned, sub-licensed or otherwise transferred by the customer without prior written consent from CBS. No right to print or copy in whole or in part is granted. This license is the personal property of the customer and the customer is expressly prohibited from lending, hiring, renting, selling or otherwise transfering the licensed program or its documentation to a third party.

3. Protection and Security

The customer agrees not to provide or otherwise make available a licensed program to any other person other than his employees and/or duly authorised agents without prior written consent from CBS and at all times to retain the licensed program at the address declared by the customer.

4. No Liability For Consequential Damages

Although CBS has tested the software and reviewed the documentation, CBS makes no warranty or representation, either express or implied, with respect to this software or documentation, their quality, performance, merchantability or fitness for a particular purpose. This software and documentation is licensed ‘as is’ and by using this product the licensee is assuming all risk as to their quality and performance.

In no event will CBS be liable for direct, indirect, special, incidental or consequential damages arising out of the use or inability to use the software, even if advised of the possibility of such damages. CBS has no liability for any programs or data stored or used with the Haulier Software.
